Terms of Service

These Terms of Service (“Terms”) govern access to and use of all created MCP Apps by MB Janus Digital, including our website, AI-powered applications, GPT-based tools, pages, features, and related services collectively referred to as the “Services.”
The Services are operated by MB Janus Digital (“Company,” “we,” “our,” or “us”).
By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, you should not access or use the Services.
1. Description of the Services
The Services provide AI-powered tools that may help users generate, summarize, organize, analyze, transform, or format information based on user-provided inputs.
Depending on the specific tool being used, the Services may allow users to submit prompts, questions, text, links, documents, files, personal details, preferences, goals, or other information in order to receive AI-generated outputs.
The Services are intended for informational, creative, productivity, entertainment, educational, and convenience purposes only. The Services do not replace professional advice, independent judgment, or verification by the user.
2. Scope of These Terms
These Terms apply to all websites, applications, GPTs, pages, tools, and related services operated by us.
Some Services may operate within or rely on third-party platforms, including OpenAI’s ChatGPT platform or other third-party services. Use of those third-party platforms may also be subject to their own terms, policies, and rules.
If additional terms apply to a specific feature, tool, subscription, or service, those additional terms will apply together with these Terms.
3. Eligibility
You may use the Services only if you are legally permitted to do so under applicable law and under the rules of any third-party platform used to access the Services.
By using the Services, you represent that you meet any minimum age, account, location, and eligibility requirements that apply to the Services and to any third-party platforms used with the Services.
If you use the Services on behalf of an organization, you represent that you have authority to accept these Terms on behalf of that organization.
4. Acceptable Use
You may use the Services only for lawful purposes and in a way that does not harm, disrupt, overload, misuse, or interfere with the Services, our systems, third-party platforms, or other users.
You must not:
use the Services for unlawful, fraudulent, deceptive, abusive, harmful, or misleading purposes;
submit content that is false, unlawful, infringing, defamatory, abusive, harmful, or that violates the rights of another person or entity;
impersonate another person or misrepresent your identity, qualifications, credentials, authority, background, or intentions;
use the Services to create, assist, or facilitate scams, spam, phishing, malware, security abuse, manipulation, or other harmful activity;
submit content that you do not have the right to use, upload, process, summarize, or transform;
use the Services to violate intellectual property, privacy, publicity, confidentiality, or contractual rights;
attempt to gain unauthorized access to the Services, related systems, accounts, data, or infrastructure;
interfere with, reverse engineer, copy, scrape, overload, disrupt, or commercially exploit the Services except as permitted by law or with our written permission;
bypass, disable, or interfere with safety, security, usage, or access controls;
use the Services in a way that violates applicable law, these Terms, or the terms and policies of any third-party platform used with the Services.
We may suspend, restrict, or terminate access to the Services if we reasonably believe these Terms are being violated or the Services are being misused.
5. User Content
You may submit content to the Services, including prompts, questions, text, links, documents, files, personal information, profile details, preferences, goals, health or fitness information, career information, or other materials provided by you or on your behalf (“User Content”).
You retain any rights you have in your User Content.
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, transmit, process, analyze, format, display, and generate outputs from your User Content only as needed to operate, provide, maintain, secure, and improve the Services, subject to our Privacy Policy.
You are responsible for ensuring that:
you have the right to submit and use the User Content;
the User Content is accurate, lawful, and not misleading;
the User Content does not violate the rights of any third party;
the User Content does not include information you are not permitted to disclose.
You should not submit highly sensitive information unless it is necessary for the specific Service you are using and you are comfortable providing it.
6. AI-Generated Outputs
The Services may generate text, summaries, recommendations, drafts, analyses, documents, estimates, classifications, explanations, or other outputs based on User Content and other available information (“Outputs”).
Outputs are generated automatically and may not always be accurate, complete, current, reliable, lawful, appropriate, or suitable for your intended purpose.
You are responsible for reviewing, editing, verifying, and deciding whether to use any Output. You should not rely on Outputs as the sole basis for important decisions.
Subject to these Terms and applicable law, you may use Outputs for your personal or internal business purposes. You are responsible for ensuring that your use of Outputs complies with applicable law and does not violate third-party rights.
7. No Professional Advice
The Services do not provide legal, medical, health, nutrition, financial, tax, employment, immigration, psychological, safety, or other regulated professional advice.
Any information or Output provided by the Services is for general informational and convenience purposes only. It should not be treated as a substitute for advice from a qualified professional.
For decisions involving health, safety, employment, finances, legal rights, legal obligations, or other important matters, you should consult an appropriate qualified professional.
8. User Responsibility for Decisions
You are solely responsible for your decisions, actions, submissions, communications, and use of the Services and Outputs.
We do not guarantee that the Services or Outputs will produce any particular result, including employment outcomes, business outcomes, health or fitness outcomes, financial outcomes, academic outcomes, personal outcomes, or other results.
You are responsible for checking any Output before using, publishing, submitting, sharing, or relying on it.
9. Third-Party Content and Links
The Services may allow you to submit, summarize, analyze, or interact with third-party content, including links, webpages, videos, documents, articles, or other materials.
You are responsible for ensuring that you have the right to submit or process third-party content through the Services.
We do not control and are not responsible for third-party content, websites, platforms, services, availability, accuracy, policies, or practices.
References to third-party content, services, or platforms do not imply endorsement by us.
10. Privacy
Use of the Services is also subject to our Privacy Policy, which explains how we collect, use, store, share, and protect information in connection with the Services.
By using the Services, you acknowledge that your information may be processed as described in our Privacy Policy.
11. Third-Party Services and Platforms
The Services may operate through, integrate with, or rely on third-party services, including AI model providers, hosting providers, authentication services, analytics services, payment processors, file-generation tools, infrastructure providers, and communication platforms.
We are not responsible for third-party services that we do not control. Your use of third-party services may be governed by their own terms, policies, and privacy notices.
Where the Services operate within ChatGPT or use OpenAI technology, your use may also be subject to OpenAI’s applicable terms, policies, and platform rules.
12. Intellectual Property
The Services, including software, systems, workflows, prompts, designs, branding, logos, text, website materials, interfaces, and related content, are owned by MB Janus Digital or its licensors and are protected by applicable intellectual property laws.
Except as allowed by these Terms or applicable law, you may not copy, reproduce, modify, distribute, sell, resell, sublicense, reverse engineer, or commercially exploit the Services or any part of them without our written permission.
Nothing in these Terms transfers ownership of our intellectual property to you.
13. Feedback
If you provide comments, suggestions, ideas, requests, or other feedback about the Services, you grant us the right to use that feedback without restriction or compensation to you.
We may use feedback to improve, develop, market, or modify the Services.
14. Payments and Paid Features
Some Services or features may be offered for free, while others may require payment, subscription, credits, or another form of paid access.
If paid features are offered, pricing, billing terms, renewal terms, cancellation rules, and refund rules will be provided at or before purchase.
Unless otherwise stated, payments are non-refundable to the maximum extent permitted by applicable law.
We may change pricing, features, or availability from time to time. Changes will not affect purchases already completed unless stated otherwise or required by law.
15. Availability and Changes to the Services
We may update, modify, suspend, limit, or discontinue any part of the Services at any time.
We do not guarantee that the Services will always be available, uninterrupted, secure, accurate, or error-free.
The Services may be affected by maintenance, updates, technical issues, internet disruptions, third-party platform changes, provider outages, or other events outside our control.
16. Beta, Experimental, and AI Features
Some Services or features may be experimental, newly released, in testing, or dependent on AI systems that may behave unpredictably.
Such features may change, fail, produce unexpected results, or be discontinued at any time.
You should carefully review any Output from experimental or AI-powered features before relying on it.
17. Suspension and Termination
You may stop using the Services at any time.
We may suspend, restrict, or terminate your access to the Services if we reasonably believe that:
you violated these Terms;
you misused the Services;
your use creates legal, security, operational, reputational, or technical risk;
your use violates the rights of another person or entity;
we are required to do so by law or by a third-party platform provider.
After termination, provisions that by their nature should continue to apply will remain in effect, including provisions on intellectual property, disclaimers, limitation of liability, and governing law.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis.
We make no warranties, express or implied, regarding the Services or Outputs, including warranties of accuracy, completeness, reliability, availability, security, fitness for a particular purpose, non-infringement, or suitability for your intended use.
We do not warrant that the Services will meet your expectations, produce a particular result, or be free from errors, interruptions, inaccuracies, omissions, or harmful components.
19. Limitation of Liability
To the maximum extent permitted by law, MB Janus Digital will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising from or related to your use of, or inability to use, the Services.
This includes damages related to lost profits, lost revenue, lost opportunities, lost data, business interruption, reputational harm, inaccurate Outputs, reliance on Outputs, third-party decisions, or actions taken based on the Services.
To the maximum extent permitted by law, our total liability for any claim arising from or related to the Services will not exceed the amount you paid to us for the specific Service giving rise to the claim during the three months before the claim arose, or EUR 100 if you did not pay us for that Service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
20. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless MB Janus Digital, its owners, employees, contractors, service providers, and partners from and against claims, losses, liabilities, damages, costs, and expenses arising from or related to:
your use or misuse of the Services;
your User Content;
your use of Outputs;
your violation of these Terms;
your violation of applicable law;
your violation of third-party rights.
This section applies only to the extent permitted by applicable law.
21. Consumer Rights
Nothing in these Terms limits any mandatory consumer rights that cannot be waived under applicable law.
If you are a consumer, you may have legal rights in your country of residence that apply regardless of these Terms.
22. Changes to These Terms
We may update these Terms from time to time.
If we update these Terms, we will post the revised version with a new effective date. Where required by law, we may provide additional notice.
Your continued use of the Services after updated Terms become effective means that the updated Terms apply.
If you do not agree to the updated Terms, you should stop using the Services.
23. Governing Law
These Terms are governed by the laws of [Lithuania / chosen jurisdiction], without regard to conflict of law principles, unless mandatory laws in your country of residence require otherwise.
Any disputes will be handled by the courts or dispute-resolution bodies that have jurisdiction under applicable law.
24. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid, illegal, or unenforceable provision will be interpreted or replaced to the extent necessary to make it valid, legal, and enforceable while preserving its original intent as closely as possible.
25. Entire Agreement
These Terms, together with any additional terms and our Privacy Policy, form the entire agreement between you and us regarding the Services.
They replace any prior or separate understandings relating to the Services, unless otherwise stated in writing.
